Terms of Use
1. The agreement
These Terms of Use are an agreement between you and ALDIAN SRL ("we", "us"), publisher of the CyberGuard VPN app. By downloading or using the app you accept them. If you do not accept them, do not use the app.
Our handling of data is described separately in the Privacy Policy, which forms part of this agreement.
2. What the service is
CyberGuard VPN is a VPN client for iOS. It establishes an encrypted tunnel between your device and a server we operate, and routes your internet traffic through it. While the tunnel is active, the services you connect to see the IP address of that server rather than the address assigned by your network.
The app is a VPN client and nothing else. It does not scan your device, it does not detect viruses or malware, and it does not monitor your battery, storage or system performance. It does not make you anonymous online, and it does not protect you from giving your own information to someone who asks for it.
3. Who may use it
You must be old enough to enter into a binding contract where you live, and old enough to hold your own Apple Account. If you are under that age, an adult responsible for you must agree to these terms on your behalf. You are also responsible for making sure that using a VPN is lawful in the country you use it from.
4. Subscriptions and billing
The app is free to download. Connecting through our servers requires an active subscription, sold as an auto-renewable in-app purchase through the App Store.
- Plans. Weekly, monthly and yearly plans are offered. The plans available to you, their prices in your local currency, and the terms of any introductory or trial offer are shown on the purchase screen in the app before you confirm.
- Payment. Payment is charged to your Apple Account when you confirm the purchase. All payment processing is done by Apple. We do not receive your card details.
- Renewal. Subscriptions renew automatically at the end of each period, at the price then in force for your plan, unless renewal is turned off at least 24 hours before the period ends. Your Apple Account is charged for the renewal within 24 hours before the new period starts.
- Trials and introductory offers. Where an offer includes a free or discounted period, that period converts into a paid renewing subscription unless you turn renewal off before it ends. Unused time in a free trial is forfeited if you buy a subscription during the trial.
- Price changes. If we change the price of a plan, Apple notifies you and asks for your consent before the new price is charged, in the way Apple's own rules require. You can decline by cancelling.
5. Cancelling
You cancel a subscription through Apple, not through us. On your device open Settings → your name → Subscriptions, select CyberGuard VPN and turn off renewal. Deleting the app does not cancel a subscription.
Cancelling stops future charges. The subscription stays usable until the end of the period you have already paid for.
6. Refunds
Purchases are made through the App Store, so refunds are decided by Apple under Apple's terms. We cannot issue, approve or reverse a refund on your behalf, and we cannot see your payment method. A refund is requested from Apple, through the purchase history of the Apple Account used for the purchase.
If something in the app is broken, write to us first at support@sun-vpn.online. Fixing the problem is usually faster than a refund cycle, and if we cannot fix it we will say so plainly.
7. Acceptable use
You agree not to use CyberGuard VPN:
- to break the law of any country that applies to you, or to help someone else do so;
- to send spam, to attack or scan networks and systems, or to distribute malware;
- to infringe someone else's copyright or other rights;
- to interfere with our servers or with other users' access to them, including by circumventing technical limits or reselling access;
- to hide the origin of harassment, threats or fraud.
We may suspend a connection or block traffic that we reasonably believe falls into the list above, in order to keep the service running for everyone else.
8. Availability
We work to keep the service available, but we do not promise that it will be uninterrupted or error free. Server locations, capacity and protocols can change. Connection speed depends on your own network, on distance to the server and on load, and part of it is outside our control. Maintenance may take servers offline temporarily.
9. Ownership
The app, this website, our name and our logo belong to us or to our licensors. Your subscription buys you the right to use the app on devices you control, personally and not commercially, for as long as the subscription is active. It does not transfer any ownership. You may not copy, modify, reverse engineer or redistribute the app except where the law expressly allows it.
10. Disclaimer
The app is provided "as is" and "as available", without warranties beyond those that the law where you live gives you and that cannot be excluded. In particular, we make no warranty that the app will make you anonymous, that it will prevent every form of tracking, or that it will meet a specific purpose you have in mind for it.
Nothing in this section takes away consumer rights you have under the mandatory law of your country of residence.
11. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, for lost profits, or for loss of data arising from your use of the app. Where we are liable, our total liability is limited to the amount you paid us for the subscription in the twelve months before the event that caused the loss.
We are not excluding liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
12. Termination
You can stop using the app at any time by cancelling the subscription and deleting the app. We may suspend or end your access if you materially breach section 7, or if we stop offering the service. If we end the service while you have paid for a period that has not run out, contact us and we will help you seek a pro rata refund from Apple.
13. Apple
The following applies because the app is distributed through the App Store:
- This agreement is between you and us, not with Apple. Apple is not responsible for the app or its contents.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. Beyond that, Apple has no other warranty obligation for the app.
- Apple is not responsible for addressing claims by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal requirement, and claims under consumer protection or privacy law.
- Apple is not responsible for investigating, defending or resolving any third-party claim that the app infringes intellectual property rights.
- You confirm that you are not located in a country subject to a United States Government embargo, and that you are not on any United States list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce its terms against you.
14. Changes to these terms
We may update these terms when the service or the law changes. The current version always sits on this page with its date at the top. If a change materially reduces what you get, it applies from your next renewal, not retroactively, so you can cancel first if you disagree.
15. Governing law
These terms are governed by the law of the jurisdiction in which ALDIAN SRL has its registered office, and the courts of that jurisdiction have non-exclusive jurisdiction over disputes. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of your own country of residence, and you may bring proceedings there.
